From the complaint:

"Defendant owns the registered domain name twitter,com, and pursuant
thereto, twitter.com/TonylaRussa ('-the Site")... The domain name of this Site, and plaintiffs name used on the Site itself are unauthorized uses of Plaintiff's trademark, his name."

This seems to show some technical confusion between domain names and other parts of URLs such as file paths.

I don't believe Twitter failed to respond. The complaint alleges a lot of things, but failure to respond to a take down request is not one of them. I chalk this up as another lawsuit that does more harm then good. http://bit.ly/4Yue4
